At the law firm of Robert J. DeGroot, we have defended clients in New Jersey, New York and Westchester against serious criminal allegations since 1972. As white collar crime lawyers, we are proactive and aggressive, working to prevent charges from being filed against our clients to begin with. If that is not possible or if you have already been charged, we will work quickly and skillfully to unravel the facts and build a strong defense on your behalf. Being charged with embezzlement is a serious crime and must be addressed immediately so that you do not incriminate yourself or others.
There are special penalties for special property or defendants, too. Many states single-out embezzlement of particular kinds of property or by certain defendants, and punish those crimes more severely than other embezzlement offenses. We’ll take a look in today’s post, so keep reading to learn more.
Which Crimes Are Punished More Severely?
We mentioned above that some crimes can be punished more severely than other embezzlement offenses. Here are a few examples:
- Religious items worth more than $100
- An animal taken for the purpose of animal fighting
- A biological sample, culture, microorganism, or records of a scientific secret, technical process, or invention
- An object that has inherent, subjective, or idiosyncratic value to its owner even if the property has no market value or replacement cost; utility company property
- Embezzlement by someone who is in a contractual relationship with the government
Plus, there’s restitution, too. Many states require defendants to pay restitution to their victim(s). This usually involves repaying the victim for the monetary value of the money or property embezzled. When applicable, restitution is most often in addition to the applicable fines and prison time.
