Just Now Finding Out That You Are Accused of Committing Tax Fraud?

You’re going about your day as you normally would. Wake up, take a quick shower, brush your teeth. You head downstairs to start the coffee maker and grab the newspaper from the front porch before stepping out the door and heading out to work. Your day at the office is the same as usual–you fire up your computer, respond to what seems like a million emails, and attend a meeting or two.

At the end of the day, you head home from work and that’s when you get the phone call–you are being investigated for tax fraud. “Tax fraud?” you wonder to yourself. “But I filed my taxes way back in March!” Needless to say, you might be feeling more than a little bit confused. If you’ve never been accused of committing tax fraud before–and let’s hope that this is true for most of the people who might be reading this blog–then you may assume that you’ll be notified of such an accusation shortly after you file your taxes.

So What Happened Exactly?

The truth of the matter is that regardless of when you file your taxes, authorities are still looking for cases where tax fraud may have been committed. It doesn’t matter if they uncover it in April or in August, the fact remains that people do commit tax fraud and that others are actively looking to uncover evidence of a crime.

Of course being accused of committing tax fraud doesn’t necessarily mean that you are guilty! Thankfully here in the United States, you are innocent until proven guilty. The thing that can be terrifying for a number of people, however, is knowing that there are people out there who are actively looking to uncover evidence of a crime. That can be disconcerting if you filed your taxes normally and are then alerted to the fact that you are under investigation.

Hiring a Good Tax Fraud Attorney is the Answer

Just like with any of the crimes that are committed, there are instances where the guilty end up in jail and other times they go unpunished. Similarly, you may be innocent of the crime you are accused for, but that doesn’t mean that you’re automatically off the hook. That’s where having a good criminal defense attorney can play a large part. The task of proving your innocence falls to you and you’ll need someone in your corner who knows the ins and outs of the charges that have been leveled against you. That’s where we come in.

At the Law Offices of Robert J. DeGroot, our goal is to provide you with the defense you need in the middle of a difficult and stressful situation. We’ve been in the business long enough to have seen it all and we can truly empathize with what you’re going through. Having someone you can count on to uncover all of the facts in your case and then fight tenaciously for you, defending your rights and building a case in your defense, is vitally crucial.

Schedule a Consultation Today

You deserve to be backed by a team that supports you and that’s what we’re here for. We’ll work with you every step of the way to ensure that we reach a positive outcome for your particular situation so you can get back to your normal life. It’s as simple as that.

No matter what you’re up against, you should know that there is help. If you’re in the Newark area and you have recently been accused of a crime, the team at the Law Offices of Robert J. DeGroot can help to take great care of you during your trying time. We have over four decades of experience in dealing with cases like yours and we would love to speak with you. Have You Been Falsely Accused of Tax Fraud?

There’s not much that’s more alarming than being accused of a crime you didn’t commit. Although in the eyes of the law you are innocent until proven guilty, being charged with a crime can come with a number of consequences. Unfortunately even though you haven’t been proven guilty, that’s not always how people will see you, and in fact, simply being charged with a crime is often enough to tarnish your reputation.

Take tax fraud for example. Imagine a scenario where you are at home enjoying a cup of coffee with your family when the bad news comes–you’ve been accused of tax fraud. Your family and friends believe that you’re innocent, but what about your coworkers? It’s a truly unfortunate circumstance to find yourself in, but there is hope!

Hire an Attorney for Fraud Cases

Regardless of your situation, the right move is to call an attorney as soon as possible. Even if you believe that you’ve done nothing wrong, people–including police officers and investigators–may suspect otherwise. We always like to advise that acquiring help from a lawyer with experience in the field of fraud should be retained as early in the process as you’re able to.

You see, having a good lawyer by your side ensures that no matter what charges are brought against you that you’ll have someone you can trust to help you navigate the complexities of fraud cases. As you can probably imagine, these cases are often difficult to get to the bottom of. That means that having someone with experience is an absolute necessity in making it through your situation and securing a positive outcome for your situation.

What is Tax Fraud?

There are a number of different tax fraud charges with might require the assistance of a federal defense attorney. From tax evasion to filing a falsified tax return to simply failing to file a tax return altogether, the number of different charges that can be brought against you can feel overwhelming.

If you’ve ever done your own taxes before, you know how confusing it can be to make your way from the beginning of the paperwork to the end of it. It often seems overly complex and it’s easy to misunderstand what is needed from you. In other words, there are a lot of things that can go wrong and whether your alleged crime was intentional or not, you’re going to need someone with experience to be by your side.

Put Your Trust in Our Experience

At the Law Offices of Robert J. DeGroot, we are fully dedicated to helping each of our clients to the best of our ability. To that point, New Jersey tax fraud attorney Robert J. DeGroot has been working to help those who have been charged with crimes for over forty years. With four decades of experience, you can rest assured that you’re in the best hands possible to help defend against whatever comes your way.

We know that what you’re going through is incredibly difficult. It’s a test of how well you can deal with pressure and we strongly believe that it’s good to have a solid support system in place. As helpful as friends and family will no doubt be as you go through such a trying time, having a good lawyer on hand can help even more.

We are not trying to downplay the role of loved ones while you’re going through difficulty at all and in fact we encourage you to take full advantage of the ones around you who can offer encouragement and moral support. As we mentioned above though, bringing in a lawyer as early as you can will also no doubt help to bring you the peace of mind you need when times get tough.

Why You Should Speak to an Attorney Before Making a Statement

When you’re being investigated for a white collar crime, whether it’s tax fraud, tax evasion, bank fraud, or anything else, chances are that you’ll be notified that an investigation is underway. Your natural instinct, of course, will be to be cooperative with any officers or agents who are conducting the investigation. At some point or another, in an attempt to get to the bottom of things, these people might ask you to give a statement.

Whether you’re guilty or innocent, one of the worst things you can do is to make a statement without having an attorney present. Sure, you might just be trying to help or clear things up, but it’s always in your best interest to have a lawyer present who can advise you. At the Law Offices of Robert J. DeGroot, we always advocate for hiring a lawyer as early into the process as you possibly can because we can provide you with helpful advice at every step of the road.

Robert J. DeGroot to the Rescue

It might seem like an awkward situation to be in. After all, if you’re not guilty of committing any crimes, chances are that you’ll want to tell your side of the story and clear your name. You may even feel that asking for a lawyer is evidence of your incrimination or that it will make you look bad. Trust us when we say that this couldn’t be further from the truth. No matter who you’re speaking to, they’ll very likely understand what you’re going through and all you have to say is that it seems like you’re in a rather serious situation and you’d like to speak with your lawyer.

Any levelheaded person will understand that this is in your best interest because it’s likely that they would do the same thing if they were in your situation.

When to Call a Tax Fraud Lawyer

No one ones to experience tax-related confusion. After all, just the task of getting your taxes done can be more headache than most people care to experience. With so many confusing forms and options, it’s almost impossible for the average person to know if they’re doing it right. Even with the help of an experienced tax preparer, things can sometimes go awry.

Here are three instances in which it would be a great idea to get in touch with a tax fraud lawyer:

The IRS Informs You of an Audit

No one wants to be audited by the IRS, but the fact of the matter is that it happens. Unfortunately in these cases, the burden of proof all falls on you. That means that hopefully you kept track of all of your paperwork, because if you didn’t and there’s an issue that arises, it could be a big problem.

IRS audits are often a complicated thing for the average person. Luckily for you, when you hire a tax fraud lawyer, he or she will know the ins and outs of what’s going on, offering you suggestions and advice along the way. In scenarios like this, it’s always best to have someone who’s in the know keeping track of your situation, wouldn’t you agree?

The IRS Informs You of Criminal Charges

This is one scenario where you absolutely, positively need to hire a tax fraud lawyer. If you’re being charged of a crime (such as tax fraud), probably the worst possible thing you can do would be to try to figure it out on your own. Instead, hiring a tax fraud lawyer helps to put the ball back in your court.

By working with a tax fraud attorney, you can set yourself up for as much success as possible. The IRS is notoriously not very lenient, so it makes sense to have a team on your side who can help to minimize any damage and provide you with a scenario that works best for you.

The IRS Sends You a Notice

Perhaps you’ve recently received a notice from the IRS stating that you owe them money. “I don’t think I did my taxes wrong,” you think to yourself. “I don’t really understand why they’re asking me for this money.” Finding yourself in this position can be pretty scary, even if you’ve done nothing wrong. Because taxes are such a complicated and confusing thing to people, they automatically assume that they’re in trouble if they receive a notice like this.

The good news is that an experienced tax fraud lawyer can help you to sort this situation out. It could be as simple as an error on your tax return or an issue on their end. Either way, having someone on your side who knows the ins and outs of state and federal tax code will be to your advantage in a situation like this.

“I Never Received My W-2”

Every year tax season comes and employers mail at their W-2. But what if your W-2 never arrives? W-2 are required to be in the mail by January 31st of each year but for various reasons some W-2s never reach their destination. Here are the steps you should take to avoid being contacted by the IRS for tax fraud when filing your taxes for a missing W-2.

  1. Contact Your Current or Past Employer

Your first step should always be to contact the employer. Make sure they mailed the form to the correct address or double check to see if it was returned to them by the Post Office. In many cases, the missing W-2 can be resolved at this step. However, if you are still unable to gain your wage information by February 14th, your next step would be to contact the IRS.

  1. Contact the IRS

If you cannot track down your W-2, give the IRS a call at 800-829-1040 and be prepared to provide them with detailed information about yourself and your employer, including an estimate of wages. They will instruct you on the next steps you need to follow. If you file your taxes through programs such as TurboTax, they provide information on how to correctly estimate your wages and withheld taxes. They also provide you with the proper steps and forms that need to be sent to the IRS with your tax return.

Remember, any wages recorded by an employer to the IRS need to be accounted for in your personal tax return even if you do not receive a W-2 or this is a form of tax fraud. Failure to do so may result in the need of a tax fraud lawyer further down the line due to unpaid back taxes and failure to pay.

Simple Defenses Against A Tax Evasion Charge

dreamstime_xxl_35184487Although the IRS will generally not pursue negligent taxpayers, they take tax evasion crimes very seriously. Tax evasion is a type of tax fraud, and it’s exactly what it sounds like: the intentional avoidance of paying taxes. A person being charged with tax evasion will find little sympathy for weak defenses such as not being able to pay or intending to pay in the future. However, there are other possible defenses against tax evasion that may find success:

  1. Inadequate Evidence

In order for you to be charged with tax evasion, it must be proven that you intended to avoid paying. Proving this one way or the other can be tricky, but the charges can be dropped if you have evidence, for example, that you simply forgot to file. If you use a professional tax service and are able to prove that you were acting according to advice given to you by these professionals, this might also be sufficient in illustrating a lack of intent.

  1. Negligence (Honest Mistake)

Sometimes, taxpayers are simply mistaken. You might have gotten the date confused, or you may have been mistaken about what you need to report. The IRS has systems in place to recognize tax fraud over accidental negligence, but that doesn’t mean you’ll never be audited for a mistake. Talk to your attorney about your specific case if you believe you’re being charged based on an honest mistake.

  1. Entrapment

Entrapment occurs when a person is tricked into committing a crime he or she wouldn’t normally commit. If you believe that you were tricked into committing tax evasion, contact the Law Offices of Robert J. DeGroot, and we’ll discuss your case.

Do you need defense for a tax fraud charge in the Newark area? The criminal defense professionals at Robert J. DeGroot have been providing trusted defense against criminal charges since the early 1970s.

Three Qualities You Need In A Defense Attorney

dreamstime_xxl_27008815If you’re facing a criminal charge, the most important step you can take is to call an appropriate defense attorney. For serious, complex charges such as tax evasion or other tax fraud charges, the attorney you choose needs to have a few specific qualities in order to give you the best possible result. If you’re looking for a criminal defense attorney, consider whether or not your potential candidates exhibit these qualities:

Convenience

When looking for a defense lawyer to take on your case, you should choose a firm based out of the same area where your case is pending. Besides the convenience of having your attorney close by, a lawyer who has litigated cases in your area will be more familiar with local procedures, judges, prosecutors, police, and other relevant personnel. This familiarity means your attorney will be better equipped to navigate the local system. The Law Offices of Robert J. DeGroot have been operating out of the Newark area since 1972.

Experience

A good defense attorney will have adequate experience with the offense you’re being charged with. At the Law Offices Of Robert J. DeGroot, we have over 40 years of experience limiting our clients’ exposures to damaging criminal charges. We can handle state and federal cases related to tax fraud, health care fraud and other white collar crimes, drug trafficking, and more.

Consideration

Your defense attorney should be someone who you are comfortable with. An ineffective attorney does not take the time to get to know his or her clients. At Robert J. DeGroot, we take the necessary time to get to know our client. Each client has individual needs, and no two cases are exactly alike. We give all of our clients the individualized attention they need, and we treat them with courtesy and professionalism.

Our attorneys specialize in white collar crime. Contact our offices if you need defense for a bank fraud, public corruption, tax fraud, or other charge in the Newark area.

Don’t Panic If You Can’t Pay Your Taxes

Crimes like tax evasion are very serious, but what if you just can’t afford to pay your taxes? The IRS recognizes that a simple inability to pay should not be treated the same way as a failure to file or a false return. There are procedures and programs in place to keep you and the IRS on agreeable terms if you don’t have the financial stability to pay the taxes you owe. One of the most important things the IRS wants you to do in this situation is to file anyway. Even if you can’t pay the full amount owed, file anyway, do so on time, and pay what you can in order to avoid late charges or failure to file penalties (your account will still accrue interest until the full amount is paid).

Once you have filed on time, you might qualify for an extension. The IRS can make full payment agreements, where the taxpayer is given up to 120 days of additional time to pay the outstanding amount in full. Another possibility is to request an installment agreement. If you qualify, you’ll agree to pay a manageable monthly amount via direct debit, payroll deduction, EFTPS, credit card (via phone or internet), or check/money order. For more information on installment agreements, visit IRS.gov.

If both of the above options will not do, you might consider proposing an offer in compromise, which is an agreement between the IRS and a taxpayer stating that if the taxpayer pays an agreed upon reduced amount, then the tax liability will be completely resolved. Still another option is a temporary delay. If paying even a portion would keep you from meeting your basic living expenses, the IRS may temporarily report your account as being currently not collectible until a time comes when you can afford to pay.
